Introduction
These Terms and Conditions and Privacy Policy govern the use of the Agora platform, which is accessible through designated web addresses. By accessing and using this platform, you agree to comply with these terms. If you do not agree, you must refrain from using the platform.
The Universitat Politècnica de Catalunya (UPC), representing the aUPaEU Consortium Members, owns and manages the platform and reserves the right to update these terms periodically.
Definitions
- "Platform": Refers to the Agora platform.
- "User": Any person who accesses or registers on the platform.
- "aUPaEU Consortium Members": The institutions collaborating in the aUPaEU project.
- "Resources": Any materials (documents, data, multimedia content) shared on the platform.
- "Personal Data": Any data that identifies a User (e.g., name, email).
Use of the Platform
The platform is provided exclusively for research, education, and innovation purposes.
Users must not:
- Publish, distribute, or commercialize any platform material.
- Engage in data mining, extraction, or harvesting.
- Violate any applicable laws when using the platform.
- Share confidential or personal data of third parties without authorization.
The aUPaEU Consortium Members reserve the right to restrict access to any user violating these terms.
User Registration and Authentication
- Users access the platform via eduGAIN, which provides authentication using name, surname, and email, and LinkedIn, which provides authentication using name, surname, and email.
- Users are responsible for the accuracy of any additional data they provide on the platform.
Intellectual Property
- The UPC and aUPaEU Consortium Members retain ownership of the platform and its underlying technology.
- Users retain ownership of the content they upload but grant UPC a non-exclusive, worldwide, sub-licensable license to store, display, and distribute it within the platform’s scope.
- The use of third-party copyrighted material without proper authorization is strictly prohibited.
Data Privacy and GDPR Compliance
Data Collected
- The platform collects and processes:
- Name, surname, and email (from eduGAIN authentication and LinkedIn authentication).
- Any additional data users provide voluntarily.
- Emails sent to or received from the platform (processed for legitimate platform use).
Data Processing Purpose
- Personal data is processed for:
- User authentication and access control.
- Facilitating communication within the platform.
- Improving platform functionality and security.
- Ensuring compliance with aUPaEU project regulations.
Legal Basis for Processing
- Data processing is based on legitimate interest (for platform functionality) and user consent (when providing additional information).
- The platform complies with Regulation (EU) 2016/679 (GDPR).
Data Retention
- Personal data is retained only as long as necessary for platform operation.
- Users may request data deletion by contacting agora@widening.eu.
Data Security
- The platform implements technical and organizational security measures to protect user data.
Limitation of Liability
The platform is provided "as is", without guarantees of availability or accuracy.
UPC and aUPaEU Consortium Members are not liable for:
- User-generated content.
- Unauthorized data usage by third parties.
- Any technical failures affecting platform accessibility.
Termination of Use
- Users may terminate their account at any time.
- UPC may suspend or terminate access if a user violates these terms.
- Upon termination, users' data and contributions may remain accessible unless explicitly deleted.
Amendments to these Terms
- UPC reserves the right to update these terms.
- Users will be notified of any significant changes.
Governing Law & Jurisdiction
- These terms are governed by the laws of Spain.
- Any disputes shall be resolved in the courts of Barcelona.
